Regular meeting of the Hadley Town Board, Thursday October 14th 2010, held at 7PM at the Hadley Town Hall, 4 Stony Creek Road, Hadley, N.Y.

Motion was made by Charles Ovitt seconded by James Brewster to approve the minutes as written for the meeting held on Thursday September 9th 2010. All Ayes.
Motion was made by Carl Lawrence seconded by Charles Ovitt to approve these transfers:
General: Transfer$6,314.42 from Code 1910.4 (Unallocated Insurance) to Code 5110.4 (General Repairs)

Transfer: $4,574.51 from Code 5140.1 (Misc Payroll) to Code 5130.1 (Machinery Payroll)

BE IT RESOLVED that the Hadley Town Board have audited all pre-paid vouchers and all have been approved. All Ayes.

RESOLUTION # 71 was made by a motion from Carl Lawrence seconded by Colleen DeMarsh.
BE IT RESOLVED that the Hadley Town Board have audited all vouchers and all have been approved for payment.

Public comments:
Casey Mabb, a Boys Scout presented the Town Board with a plan to build bicycle racks to set at different areas around the Town of Hadley to complete an Eagle Project. He will be asking for donations of bike parts, paint etc. If anyone has any such items they would like to donate, please call the Town Clerk.
Highway Superintendent's report was verbal. He informed the Town Board that the Fall Clean-up of leaves and branches only would take place the week of October 25th thru October 29th.
Mr. Monica also discussed the purchase of a truck which he feels would be good for a few years for the Town. After a long discussion the Board made a decision.
RESOLUTION # 72 was made by a motion from Charles Ovitt seconded by Colleen DeMarsh.
BE IT RESOLVED that the Hadley Town Board is giving permission to Highway Superintendent Joseph Monica to proceed with the bidding on the truck previously discussed with a limit of $10,000. All Ayes.
Mr. Monica also discussed the Soft Start for the District 1 Water Plant. The cost of this product will be approximately $4,500 which includes labor.
RESOLUTION # 73 was made by a motion from Charles Ovitt seconded by Colleen DeMarsh.
BE IT RESOLVED that the Hadley Town Board approves the purchase of a Soft Start for District 1 Water District at the cost of approximately $4,500 so all equipment is upgraded. All Ayes.
Supervisor's report was verbal. He informed the Town Board that a road behind Mollie's Mason Jar was in question if the Town owns it or not. After a long discussion, Councilman Ovitt suggested that a Survey/ Title Search be done.
RESOLUTION # 74 was made by a motion from Charles Ovitt seconded by Carl Lawrence.
BE IT RESOLVED that the Hadley Town Board is having a Survey and Title Search done by David Barrass, Land Surveyor on what used to be named Park Avenue Extension from a 1930's map. All Ayes.

The Town Clerk reminded everyone that the Hadley Luzerne Library was doing a presentation on "Terror In The Adirondacks" the story of Robert Garrow at 7PM October 26th.
The Lionesses are doing a Pork Dinner at the American Legion, a benefit for the Food Pantry on Saturday October 16th.
Saratoga County will be providing flu shots at the Hadley Town Hall on November 19th from 9AM - 11AM.
Roaring Brook Ranch is doing a benefit for Autism Awareness Organization, October 16th
Chris Gibson will be at the Hadley Senior/Community Center at 1PM October 20th.
The Town Clerk also received a letter from the Hadley Luzerne Historical Society thanking the Town Board for their support as they could not operate without the public's support.
The Town Clerk is also in receipt of a letter from the Cemetery Committee asking permission from the Town Board to purchase an 8x10 shed and also a gallon of poly to cover the sign to protect it from the weather.
RESOLUTION # 75 was made by a motion from Colleen DeMarsh seconded by Charles Ovitt .
BE IT RESOLVED that the Hadley Town Board is extending permission to the Cemetery Committee to purchase an 8x10 shed for supplies and tools at the cost of no more than $700 and the poly for the sign. All Ayes.
The Town Clerk also explained to the Town Board that a dog enumeration needs to be done which this had been discussed before, going door to door. The Town Clerk after discussing this matter with other Town Clerks that this could be done by mail and feels that it would be cost effective in the long run. In the letter sent to the public will be explained that a fine will be instilled to all individuals who do not license their dog. This is a State Law not a Town Law. This has to be done to control rabies among other matters. This does not mean that the Animal Control Officer will not be knocking at your door because he can at any given time. Anyone can call to inform us that someone has unlicensed dogs and the Animal Control Officer will pay them a visit and they will have to pay the fine.
The Town Clerk also would like to include in her minutes that she was in receipt of a copy of the 2011 Budget by the due date.
RESOLUTION # 76 was made by a motion from Charles Ovitt seconded by Colleen DeMarsh.
BE IT RESOLVED that the Hadley Town Board hereby accept the resignation provided to the Town of Hadley Town Board from Judge Ronald Waite effective October 31th 2010. All Ayes.
RESOLUTION OF MAINTENANCE OF (SIDEWALKS)
RESOLUTION # 77 OF 10-14-2010
RESOLUTION OF THE TOWN BOARD OF THE TOWN OF HADLEY
RESOLUTION # 77 was made by a motion from Charles Ovitt seconded by James Brewster
WHEREAS, the New York State Department of Transportation proposes to replace the Bridge carrying Route 9N over the Hudson River and reconstruct Route 9N in the vicinity of the structure in the Town of Hadley, Saratoga County and
WHEREAS, the State will include as part of the reconstruction of the above mentioned project the construction of sidewalks, pursuant to Section 10, subdivision 22, Section 46, or Section 349-c of the Highway Law, as shown on the contract plans relating to the project and,
WHEREAS, the State will provide for the construction of the above mentioned work, as shown on the contract plans relating to the project.
NOW, THEREFORE, BE IT RESOLVED that the Town of Hadley approve the construction of the sidewalks as shown on the contract plans relating to the project and that the Town of Hadley will maintain or cause to be maintained the constructed sidewalks located within the Town of Hadley, including the control of snow and ice; and
BE FURTHER RESOLVED that the Town of Hadley Town Clerk is hereby directed to transmit five (5) certified copied of the foregoing resolution to the New York State Department of Transportation.

BE IT RESOLVED that the Hadley Town Board shall hold a Public Hearing on Local Law #1 of 2010 pertaining to the Town Clerk sending the licenses to the Town residents instead of Agriculture & Markets. All Ayes.

BE IT RESOLVED that the Hadley Town Board hereby will hold a Public Hearing to adopt the Budget on Thursday November 4th 2010 at 6:30PM. All Ayes.
RESOLUTION # 81 was made by a motion from Charles Ovitt seconded by James Brewster.
BE IT RESOLVED that the Hadley Town Board hereby is changing the Working Foreman from Highway to General. All Ayes.
